Welcome to Gimmzi Smart Rewards! These terms and conditions ("Terms") apply to your access to and use of the Gimmzi Smart Rewards program ("Program") offered by Gimmzi, Inc. ("Gimmzi," "we," "us," or "our").

By accessing or using the Program, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Program.

  1. Eligibility The Program is open to individuals who are at least 18 years of age and who have a valid Gimmzi account ("Account"). The Program is void where prohibited by law.

  2. Participation To participate in the Program, you must have an active Account and be signed in to the Gimmzi mobile app or website. You can earn rewards by completing qualifying actions as outlined in the Program, such as booking a stay at a participating property or referring a friend. Rewards may be subject to restrictions, including expiration dates and minimum booking amounts.

  3. Rewards Rewards earned through the Program may be redeemed in accordance with the terms and conditions of the Program. Rewards have no cash value and are not transferable or assignable. Gimmzi reserves the right to modify or terminate the Program or any rewards at any time, without notice and in its sole discretion.

  4. Termination Gimmzi reserves the right to suspend or terminate your participation in the Program at any time and for any reason, without notice and in its sole discretion. You may also terminate your participation in the Program at any time by contacting us at suport@gimmzi.com.

  5. Privacy By participating in the Program, you agree to our Privacy Policy, which describes how we collect, use, and disclose your personal information.

  6. Disclaimer of Warranties THE PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. GIMMZI DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability IN NO EVENT SHALL GIMMZI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF THE PROGRAM, REGARDLESS OF WHETHER GIMMZI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  8. Indemnification You agree to indemnify and hold Gimmzi harmless from any and all claims, demands, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Program or your violation of these Terms.

  9. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of the United States of America. Any dispute arising out of or in connection with these Terms or your use of the Program shall be resolved exclusively in the state or federal courts located in the United States of America.

  10. Modifications Gimmzi reserves the right to modify these Terms at any time and in its sole discretion. If we make changes to these Terms, we will post the updated Terms on our website or mobile app and indicate the date of the latest revision. Your continued participation in the Program after the revised Terms have been posted constitutes your agreement to the revised Terms.
